Independent landlords, leaseholder owned management companies and managing agents responsible for the collection of service charges will need to be aware of the statutory requirements that they have to observe when collecting service charges.
Any dispute which might arise regarding the payment of service charges will be dealt with by the Leasehold Valuation Tribunal (LVT) of the Residential Property Tribunal Service. Such disputes can be complex, and involve the ability to collect considerable sums of money.
The LVT are also able to vary lease terms particularly where there has been a drafting error and the total service charge contributions at the building do not add up to 100%.
