Extending the length of the term of a lease

It is a simple fact that by the very nature of a lease, it is a wasting asset. The term of years granted at the beginning of the lease reduces as time passes with the result that it is becoming more difficult to sell leasehold properties where the lease has 80 years or less to run. Help is at hand through the statutory rights available to leaseholders of houses and flats which can compel the landlord to grant an extension to the original lease of 90 years for flats and 50 years for houses.

Our specialist Residential Leasehold Team at Thomas Eggar LLP have been actively involved in negotiating lease extensions both for landlords and leaseholders of flats under the Leasehold Reform Housing And Urban Development Act 1993 and of houses under the Leasehold Reform Act 1967.
